Unum Life Insurance Company Reverses Its Decision on Migraine Headaches

A physician client of ours purchased an Individual Disability Policy of Insurance from Unum Insurance (“Unum”) in the event she became disabled and could no longer perform her job.   Due to her development of chronic migraines, Dr. V was unable to continue working and applied for long-term disability benefits.  Unum denied Dr. V’s claim stating it had determined she was able to perform the duties of her own occupation.

In attempting to justify this wrongful denial of benefits, Unum ignored the opinions of Dr. V’s treating physicians and rendered its decision based, in part, on the opinions of its own in-house reviewing physicians, who arbitrarily determined restrictions and limitations without considering the medical evidence.

In addition, Unum also based its decision to deny her benefits on a surveillance video that in no way suggested she possessed the capability of performing duties associated with full-time work.

How We Helped Reverse This Unum Long-Term Disability Denial

Dr. V contacted our firm for assistance in preparing an appeal of the disability denial.  Our office submitted extensive evidence, including support from her treatment providers that she was incapable of performing the duties of her occupation.  The appeal we submitted to Unum was successful in overturning the adverse benefits determination and approving our client’s long-term disability benefits.

Dr. V is currently on claim and receiving long-term disability benefits from Unum.  The team at McDermott Law, LLC, headed up by Denver Disability Lawyer Shawn E. McDermott, will continue to monitor the physician’s claim and Unum’s actions.  The firm will ensure that all requests for claim documentation, required forms and medical records are promptly provided.  Our office will continue to oversee her claim with a goal of preventing a future denial of benefits.
