On April 19, 2016, Mr. B’s father applied for life insurance with New York Life Insurance Company (“New York Life”) and submitted his application by mail.  On the application, New York Life asked him only three questions about his medical condition.

  • In the past 2 years, have you had treatment or medication for or been diagnosed by a doctor as having heart trouble, stroke, cancer, lung disease, diabetes requiring insulin, liver or kidney disease, AIDS, AIDS Related Complex, or immune system disorder?
  • In the past 2 years, for any condition, have you been admitted to or confined in a hospital, nursing home, extended care of special treatment facility?
  • In the past 3 months, have you consulted a doctor or had treatment, medication or diagnostic tests of any type?

Mr. B’s father truthfully responded “no” to each of these three questions.  Later that evening, he was taken by ambulance to the emergency room with progressive abdomen distention and shortness of breath.  Tragically, he died an early death a few months later.

After Mr. B’s father died of natural causes, he and his daughter made a claim for benefits as beneficiaries under his father’s life insurance policy.  However, New York Life informed the beneficiaries that it was denying their claims, rescinding the Policy, and returning premiums.  New York Life explained that based on a review of medical records, Mr. B’s father “failed to disclose material information concerning his medical history.”

The legal team at McDermott Law, LLC submitted an appeal to New York Life on behalf of Mr. B, demanding that it pay him the benefits owed, with interest.  New York Life attempted to resolve the claim for less than half of the policy limits.
